Everyone in the United States has constitutional rights, regardless of immigration status. These protections apply to U.S. citizens, permanent residents, visa holders, undocumented immigrants, refugees, asylum seekers, and visitors. The Constitution helps protect individuals from unlawful searches, forced self-incrimination, and other forms of unfair treatment during interactions with law enforcement, including immigration authorities. While immigration laws may affect certain legal processes and outcomes, fundamental constitutional rights still apply to all people living in or present within the United States.
